Legal descriptions and exhibits are used for any recorded action affecting property: deeds, easements, lot line adjustments, leases of specific areas, dedications, abandonments, and similar. The description must be technically precise, unambiguous, and consistent with the surveyed boundary basis. If a recent boundary survey or accurate recorded reference exists, sometimes we can prepare the description from existing records. For new descriptions of unsurveyed areas, irregular shapes, easements, or LLAs, a boundary survey is typically required to establish the technical basis for the description.
Revisions are common during the title review process. Our scope typically includes reasonable revisions as the document moves through review. Significant scope changes (changing the described area, adding new components) may require additional scope and fee.
We can prepare or review a legal description from record documents, but a description that defines a new parcel, easement, or boundary for recording is prepared by a licensed surveyor and is most reliable when supported by a field survey.
